This document regulates the terms and conditions of use of the website accessed and the commercial relationship that arises between BALNEARI PRATS, S.A. (Hereinafter BALNEARI PRATS) and the users who make the distance contracting of the online Reservation services that appear on the web: www.balneariprats.com.

Please read these conditions carefully before making any reservation.
The making of a reservation and its confirmation by the User implies full acceptance of these terms and conditions.

By making a reservation on our website, you guarantee that you are over 18 years of age and that you have the necessary legal capacity to contract.

Use of reservation services

Online pre-booking service:
The pre-reservation services are merely informative and are intended to offer the user the possibility of consulting room availability.

In 24 hours the user will receive an email confirming if their reservation has been made so it will only be binding once accepted by BALNEARI PRATS by confirming the reservation by mail and subsequent payment of it by the user.
The user must verify the confirmation of the reservation and notify BALNEARI PRATS, immediately, by mail, of any error.

Online reservation service:
The purpose of the reservation service is to reserve rooms and additional services detailed on the website of BALNEARI PRATS, S.A.

Reservation / contracting procedure:
You can browse the website until you find the room, promotion or service desired. Once located, clicking on it will access all the detailed information offered by the website. From here you can add the item to your purchase.

If you are placing an order for the first time with us, you will be asked to register by entering your email address and a password with which you can create and access your account.

In case you are a registered user with an active account, you must enter your e-mail and password and the system will recognize your data.

Once you are in your account you can continue your purchase and finally confirm the order where you will be informed of the total price of the same, including VAT and the corresponding fees.

If you do not want to make any other order you have to press the “payment / confirmation” button to validate it.
All reservations are confirmed by payment of the same at the time of completion.
BALNEARI PRATS, you can charge the amount of the reservation at any time, once the same has been made.

Within 24 hours from the reception of the acceptance, you will receive the confirmation of the order by email to the e-mail address that you have indicated.

In compliance with current legislation, the process generates the corresponding contract, which will be saved, and the User will have access to it at any time during the purchase process, even later.

Warranty:
If the reservation and the payment of the same have been made correctly, this reservation is confirmed and guaranteed from that moment.
Resolution of the contract, cancellation or modification of the reservation (Accommodation):

STANDARD 24H RATE
The credit card is only a means of guarantee.

The cancellation or modification of reservations by the user will not involve early cancellation costs, provided that this is made up to 24 hours before the time of arrival.

The cancellation or modification of reservations by the user outside the period established in the previous paragraph or the failure to submit to BALNEARI PRATS will be charged as compensation the amount of the first night (VAT and taxes included).

To cancel or modify a reservation it will be essential to send an email to info@blaneariprats.com requesting cancellation or modification.

NON REFUNDABLE RATE
BALNEARI PRATS will charge the full amount of the stay booked by the client at the time of booking (VAT included). No refunds of this amount are allowed for this fee.

If BALNEARI PRATS despite acting with the due diligence and due diligence, could not provide the rooms contracted for reasons that are not attributable to them and if there was an inability to provide the services to the agreed conditions, BALNEARI PRATS may:
(I) Offer the User the possibility of opting for a full refund of the amount paid.

(II) Offer to the User, its replacement by another of characteristics and specifications similar or superior to the initially requested one, provided that these agree with the needs of the User.

(III) Offer to the User, if the substitution of the service results in a lower category or quality, the refund of the difference.

Information on the exercise of the right of withdrawal:
According to article 103.L) of Law 3/2014, of March 27, which modifies the revised text of the General Law for the Defense of consumers and users and other complementary laws, approved by Royal Decree-Legislative 1/2007, of November 16 -EDL 2014 / 35453-, Spanish legislation is adapted to the provisions of Directive 2011/83 / EU, of October 25, on consumer rights, which repeals Directives 85/577 / CEE and 97/7 -EDL 2011 / 260927-, the right of withdrawal will not be applicable to contracts that refer to:

The provision of accommodation services for purposes other than housing, transportation of goods, rental of vehicles, food or services related to recreational activities, if the contracts provide for a specific date or period of execution.

Prices
The prices will only be valid in writing and during the period indicated.

The price of each reservation will be indicated during the booking process. In accordance with current legislation, all purchases made from our website will be subject to value added tax. The applicable rate will be the legally valid at all times.

Prices may change at any time. However, the possible changes will not affect the reserves of which BALNEARI PRATS has already sent the Confirmation of the Reserve.

Supported means of payment
For the Standard 24h rate, the reservation payment can be made at the establishment (credit card data for guarantee).

• Using a credit or debit card

The amount of the order will be charged on the card, so you must indicate the number, the expiration date as well as the security code CW2 (included on the front). In case the card is secured, you will be asked for the relevant security codes.

These data will not be saved or manipulated by us, but will be registered directly in the payment gateway of the corresponding financial entity. For greater security, we will use an Electronic Commerce authentication service

Insurance, system established by Visa / Mastercard / Eurocard, by which the user authenticates before his issuing entity and the trade is authenticated before his acquiring bank.

In order to guarantee the confidentiality and integrity of the transactions, these are carried out through the SSL protocol (Secura Socket Layer) with 256-bit security keys.

The charge will be carried out in real time through this payment gateway. In case the charge can not be carried out finally (for any reason), the order will be automatically canceled.

Conflict resolution
Spanish law will be applied to this contract. The parties agree to submit for the resolution of any controversy, conflict or claim arising from this contract, to the Courts and Tribunals of Santa Coloma de Farners, expressly waiving any other jurisdiction that may apply.

Modification of the conditions of sale
We reserve the right to make changes to our website, our policies and our terms and conditions, including these General Conditions, at any time.

You will be subject to the terms and conditions, policies and General Conditions in force at the time the reservation is made, unless, by law or at the request of the public authorities, a change is made in these terms and conditions, policies or of the General conditions.

If any of the present conditions were declared invalid, void or for any ineffective reason, this condition will be understood to be excluded without this declaration affecting the validity or enforceability of the remaining conditions.

Partial nullity
In the event that any clause of these General Conditions is declared void, the other clauses will remain in force and will be interpreted taking into account the will of the parties and the purpose of these General Conditions.

The non-exercise by BALNEARI PRATS of any right derived from these General Conditions shall not be construed as a waiver of this right, unless expressly waived and in writing by BALNEARI PRATS or prescription of the action that in each case corresponds
